EXPULSIONS AT THE ZAD AT NDDL AND LES CENTS NOMS: THE PREFECT OF THE LOIRE ATLANTIQUE WILL FACE A JUDGE ON 12 APRIL AT 9 A.M.

A resident of the ZAD at Notre-Dame-des-Landes who has lived for several years in the locality known as “Les Cents Noms,” ["The Nameless" or "The Hundred Names" - ed. note] has filed an injunction against Ms. Nicole Klein, Prefect of the Department of Loire Atlantique, before the Superior Court of Nantes for illegal eviction from his home.

The president of the Superior Court granted the attorneys’ request for a summary hearing. It will take place on 12 April at 9 a.m., even as the expulsions at the ZAD continue.

In February 2013 and in January and September 2016 he had identified himself to the successive owners of the parcel he occupied. In March 2018 he again notified authorities at the Prefecture of the Loire-Atlantique of his presence. He has received no response to his numerous requests and has never been given an opportunity to duly contest his eviction.

On the morning of 9 April 2018 he was evicted from his home by police accompanied by a civil sheriff who did not bother to give him a copy of the ruling that supposedly authorized the eviction. The 100 Noms house and the adjacent sheepfold were demolished in the process.

An eviction under those conditions, outside of any legal framework, is an attack on his fundamental freedoms, and in particular the right to a fair trial, the right to property, and the right to respect for the home [Article 8 of the European Convention on Human Rights - ed. note].

Moreover it is manifestly irregular and constitutes a case of administrative misconduct and abuse which the Justice system is petitioned to sanction.

With evictions/expulsions continuing under the same conditions in the ZAD of Notre-Dame-des-Landes, the Prefecture will have to explain its acts before a judge on Thursday.
